Surveillance Capitalism
Surveillance capitalism, a term popularized and theorized by Shoshana Zuboff, names the business model in which human experience is claimed as free raw material, converted into behavioral data, and sold as prediction products. Hillebrand reads it through Austrian economics: the model inverts ordinary exchange (the user is the product, the advertiser the customer), it is entangled with state surveillance, and — crucially — its present concentration reflects state intervention as much as market outcome.
The Business Model
In ordinary exchange, businesses compete to serve customers; in data extraction, they compete to capture users. Services appear free because users pay with data, not money. Zuboff’s key construct is behavioral surplus: data beyond what a service needs to function (a map needs your location to route you; the accumulated, correlated location history is surplus) is extracted without compensation and refined into predictions sold to advertisers, campaigns, and insurers. An extraction ratchet follows — each gain in prediction accuracy makes data more valuable, justifying more intensive surveillance, asymptotically approaching comprehensive behavioral monitoring.
Hillebrand adds a praxeological caveat. Austrian economics reads demonstrated preference from what people choose, but that inference assumes unmanipulated choice. When choice architecture is engineered to exploit psychological vulnerability (variable-reward feeds, outrage amplification), hours of scrolling may reveal susceptibility rather than preference. An information asymmetry compounds it: users cannot comparison-shop on data practices they cannot observe, so competition runs on features and network effects rather than privacy.
Corporate–State Entanglement
For privacy analysis, Hillebrand argues the state-versus-corporate distinction matters less than it appears: if your communications are read, the harm is the same whether the reader is an intelligence agency or an ad platform. The two are entangled. The state uses corporate data collection as a force multiplier, reaching scope it could not legally mandate directly (the PRISM disclosures; national security letters), while the triangular intervention of data-retention and lawful-interception mandates shapes what corporations collect. The result is a public–private surveillance partnership neither party could build alone — and the constitutional constraints that bind government action do not reach corporate collection.
Is It Market Failure?
The standard critique calls surveillance capitalism a market failure — users do not want pervasive surveillance but get it anyway, an uncompensated externality — and concludes that regulation is needed. Hillebrand gives the Austrian reply on two levels.
First, the knowledge-problem (Knowledge Problem) objection: diagnosing failure requires knowing the optimal outcome the market should have produced, but optimal outcomes are discovered through the market process, not knowable in advance; what looks like failure may be discovery in progress.
Second, and more concretely, current structure reflects heavy intervention, so “the market has failed” mistakes a hampered market for a free one:
- Intellectual-property (Intellectual Property) monopolies entrench platform incumbents by suppressing compatible competitors — a major structural point.
- GDPR-style regulation imposes compliance costs incumbents absorb and challengers cannot, building a moat around the very extractors it claims to restrain.
- Government surveillance contracts make building extraction capability profitable.
- KYC/AML banking rules push activity onto tracked channels, manufacturing the data streams extraction feeds on.
Hillebrand does not claim a free market would deliver perfect privacy — network effects, switching costs, and genuine preferences for free services are real market phenomena, not intervention artifacts — but he argues today’s intensity of surveillance is not an inevitable market result.
Market Responses
Consistent with the market-process view, Hillebrand reads recent shifts as entrepreneurial discovery of latent privacy demand: Apple’s App Tracking Transparency drew an ~80% opt-out the moment users were given a clear choice (costing ad-dependent firms billions); encrypted messaging reached mainstream scale (Signal, and WhatsApp adopting the Signal protocol defensively); and paid models realign incentives by making the user the customer again. The trajectory points toward more privacy competition, but the process is early and incomplete — and market competition alone cannot reach state surveillance mandates, which is why the parallel economy turns to technical exit rather than regulatory cure.
